Aceptación de los Términos
Al utilizar Yibzer At The Table (la "Aplicación"), estos Términos y Condiciones se aplicarán automáticamente a usted. Le recomendamos leerlos cuidadosamente antes de utilizar la Aplicación.
No está permitido copiar, modificar, reproducir, distribuir, realizar ingeniería inversa o crear obras derivadas basadas en la Aplicación, cualquiera de sus componentes o cualquier marca, logotipo o propiedad intelectual relacionada.
Tampoco está permitido intentar extraer el código fuente de la Aplicación ni interferir con su funcionamiento.
La Aplicación y todos los derechos de propiedad intelectual asociados, incluyendo marcas registradas, derechos de autor, derechos sobre bases de datos y demás derechos relacionados, son propiedad exclusiva de YCS PR CORP.
Modificaciones de la Aplicación
YCS PR CORP se compromete a mantener la Aplicación útil, segura y eficiente.
Nos reservamos el derecho de modificar, actualizar, suspender o descontinuar cualquier parte de la Aplicación en cualquier momento y por cualquier motivo.
No cobraremos por servicios sin informar claramente al usuario sobre cualquier cargo aplicable antes de que este ocurra.
Información, Pedidos y Procesamiento de Pagos
Yibzer At The Table no requiere la creación de cuentas de usuario para utilizar la Aplicación.
Para realizar pedidos y completar transacciones, los usuarios podrán proporcionar información como:

Nombre o identificador del cliente;

Información relacionada con pedidos;
-
Información de mesa o ubicación;
-
Cualquier otra información necesaria para completar la transacción.
La información asociada a los pedidos y transacciones podrá ser conservada por YCS PR CORP y compartida con el comercio que opera la ubicación donde se realiza el pedido únicamente para fines relacionados con:

Procesamiento y cumplimiento de pedidos;
-
Atención al cliente;
-
Resolución de disputas;
-
Contabilidad y conciliación financiera;
-
Prevención de fraude;
-
Cumplimiento de obligaciones legales y regulatorias.
Los pagos son procesados por proveedores externos especializados.
Actualmente, los pagos son procesados mediante:

VISA Cybersource – Unified Checkout
Los proveedores de pago podrán recopilar información personal o financiera directamente del usuario para completar transacciones seguras.
YCS PR CORP no almacena números completos de tarjetas de pago, códigos de seguridad (CVV), PINes ni otras credenciales sensibles de pago.
YCS PR CORP podrá conservar información limitada relacionada con las transacciones proporcionada por los procesadores de pago, incluyendo identificadores de transacción, estados de pago, números de autorización, marcas de tarjetas, información enmascarada y otra información no sensible necesaria para fines operacionales, contables, de soporte y cumplimiento legal.

Seguridad del Dispositivo
Los usuarios son responsables de mantener la seguridad de sus dispositivos y del acceso a la Aplicación.
Recomendamos enfáticamente no realizar procesos de "jailbreak" o "root" en los dispositivos, ya que esto puede:

Eliminar protecciones de seguridad importantes;

Incrementar la vulnerabilidad a virus o programas maliciosos;

Afectar el rendimiento de la Aplicación;

Impedir el funcionamiento adecuado de determinadas funcionalidades.
YCS PR CORP no será responsable por problemas derivados de modificaciones realizadas al dispositivo del usuario.
Servicios de Terceros
La Aplicación utiliza servicios proporcionados por terceros que operan bajo sus propios términos, condiciones y políticas de privacidad.
El uso de dichos servicios puede estar sujeto a condiciones adicionales establecidas por cada proveedor.
Comercios Participantes
Yibzer At The Table proporciona una plataforma tecnológica que facilita pedidos y pagos entre usuarios y comercios participantes.
YCS PR CORP no es responsable por:

La preparación de alimentos o bebidas;

La calidad de los productos;
-
Los servicios prestados por los comercios;
-
La disponibilidad de productos;
-
Los tiempos de preparación o entrega;
-
Los precios, impuestos o cargos establecidos por los comercios;
-
Cualquier disputa relacionada con productos o servicios ofrecidos por los comercios.
Toda reclamación relacionada con productos, servicios, calidad, disponibilidad o cumplimiento de pedidos deberá dirigirse directamente al comercio responsable de la transacción.
Conectividad a Internet
Algunas funcionalidades de la Aplicación requieren una conexión activa a Internet.
La conexión puede ser proporcionada mediante Wi-Fi o por un proveedor de servicios móviles.
YCS PR CORP no será responsable por interrupciones o limitaciones derivadas de:

Falta de acceso a Internet;
-
Cobertura insuficiente;
-
Limitaciones del plan de datos;
-
Fallas de red;
-
Interrupciones causadas por proveedores externos.
Cargos por Datos y Roaming
Cuando utilice la Aplicación mediante una red móvil, continuarán aplicando los términos y cargos establecidos por su proveedor de servicios móviles.
Usted será el único responsable de:

Cargos por consumo de datos;
-
Cargos por roaming;
-
Cargos por uso internacional;
-
Cualquier otro cargo impuesto por su proveedor.
Si usted no es el titular de la cuenta asociada al dispositivo utilizado, asumimos que cuenta con la autorización correspondiente para utilizar la Aplicación.
Responsabilidades del Usuario
Los usuarios son responsables de mantener sus dispositivos operativos y con suficiente carga para utilizar la Aplicación.
YCS PR CORP no será responsable por interrupciones derivadas de:

Batería agotada;
-
Fallas del dispositivo;
-
Errores de configuración;
-
Problemas relacionados con hardware o software de terceros.
Limitación de Responsabilidad
Aunque YCS PR CORP realiza esfuerzos razonables para mantener la Aplicación funcionando correctamente y para asegurar que la información disponible sea precisa y actualizada, parte de dicha información puede ser proporcionada por terceros.
En la máxima medida permitida por la ley aplicable, YCS PR CORP no será responsable por daños directos, indirectos, incidentales, consecuentes, especiales o punitivos derivados de:

El uso de la Aplicación;

La imposibilidad de utilizar la Aplicación;
-
La confianza depositada en la información proporcionada;
-
Las acciones u omisiones de comercios o proveedores externos;
-
Interrupciones del servicio o fallas técnicas.
Modificaciones a los Términos y Condiciones
YCS PR CORP podrá modificar estos Términos y Condiciones periódicamente.
Las versiones actualizadas serán publicadas en la Aplicación o en sitios relacionados y entrarán en vigor inmediatamente después de su publicación.
El uso continuado de la Aplicación constituirá aceptación de los términos modificados.
Ley Aplicable
Estos Términos y Condiciones se regirán e interpretarán de conformidad con las leyes de Puerto Rico y las leyes federales aplicables de los Estados Unidos de América, sin consideración a principios sobre conflictos de leyes.

By downloading or using the app, these terms will automatically apply to you – you should make sure therefore that you read them carefully before using the app. You’re not allowed to copy or modify the app, any part of the app, or our trademarks in any way. You’re not allowed to attempt to extract the source code of the app, and you also shouldn’t try to translate the app into other languages or make derivative versions. The app itself, and all the trademarks, copyright, database rights and other intellectual property rights related to it, still belong to YCS PR Corp.
YCS PR Corp is committed to ensuring that the app is as useful and efficient as possible. For that reason, we reserve the right to make changes to the app or to charge for its services, at any time and for any reason. We will never charge you for the app or its services without making it very clear to you exactly what you’re paying for.
The Yibzer app stores and processes personal data that you have provided to us, in order to provide our Service. It’s your responsibility to keep your phone and access to the app secure. We, therefore, recommend that you do not jailbreak or root your phone, which is the process of removing software restrictions and limitations imposed by the official operating system of your device. It could make your phone vulnerable to malware/viruses/malicious programs, compromise your phone’s security features and it could mean that the Yibzer app won’t work properly or at all.
The app does use third party services that declare their own Terms and Conditions.

You should be aware that there are certain things that YCS PR Corp will not take responsibility for. Certain functions of the app will require the app to have an active internet connection. The connection can be Wi-Fi or provided by your mobile network provider, but YCS PR Corp cannot take responsibility for the app not working at full functionality if you don’t have access to Wi-Fi, and you don’t have any of your data allowance left.
If you’re using the app outside of an area with Wi-Fi, you should remember that your terms of the agreement with your mobile network provider will still apply. As a result, you may be charged by your mobile provider for the cost of data for the duration of the connection while accessing the app, or other third party charges. In using the app, you’re accepting responsibility for any such charges, including roaming data charges if you use the app outside of your home territory (i.e. region or country) without turning off data roaming. If you are not the bill payer for the device on which you’re using the app, please be aware that we assume that you have received permission from the bill payer for using the app.
Along the same lines, YCS PR Corp cannot always take responsibility for the way you use the app i.e. You need to make sure that your device stays charged – if it runs out of battery and you can’t turn it on to avail the Service, YCS PR Corp cannot accept responsibility.
With respect to YCS PR Corp’s responsibility for your use of the app, when you’re using the app, it’s important to bear in mind that although we endeavor to ensure that it is updated and correct at all times, we do rely on third parties to provide information to us so that we can make it available to you. YCS PR Corp accepts no liability for any loss, direct or indirect, you experience as a result of relying wholly on this functionality of the app.
At some point, we may wish to update the app. The app is currently available on Android & iOS – the requirements for both systems(and for any additional systems we decide to extend the availability of the app to) may change, and you’ll need to download the updates if you want to keep using the app. YCS PR Corp does not promise that it will always update the app so that it is relevant to you and/or works with the Android & iOS version that you have installed on your device. However, you promise to always accept updates to the application when offered to you, We may also wish to stop providing the app, and may terminate use of it at any time without giving notice of termination to you. Unless we tell you otherwise, upon any termination, (a) the rights and licenses granted to you in these terms will end; (b) you must stop using the app, and (if needed) delete it from your device.
Changes to This Terms and Conditions
we may update our Terms and Conditions from time to time. Thus, you are advised to review this page periodically for any changes. we will notify you of any changes by posting the new Terms and Conditions on this page.
